Service Contract
The following contract and its terms will set forth an agreement between iWeb Design (PROVIDER) and (CLIENT) the parties, for Web Design services during the designated service period. This written contract sets forth the full, written intention of both parties and supersedes all other written and/or oral agreements between the parties.
Payment and Termination
We would really hate to see you go. If You decide We aren’t your cup of coffee (or wine), You can end this Agreement by giving us written notice and paying Us for the Services that We have completed as well as if you have received all the FREE OFFERS that will be converted into its VALUE!
Initial Deposit is non-refundable! The remaining balance is due once we fully code your website and Admin Section. If you are not %100 sure DO NOT PROCEED!
Processing Fee
A Processing fee is for PayPal fee that is charged to transfer the funds to us. We do NOT charge you any tax, the only charges are %2.9 PayPal fee.
Timeline
We know you are excited to receive your final product, and We don’t want to leave you waiting. We will roll up our sleeves and get work once a deposit is proceeded and continue until the satisfactory completion of the Services. This means that we won’t throw the towel in until the website we develop for you is performing exactly as agreed to.
Intellectual Property
You will own the masterpiece, also known as the website, that We design for You and any visuals that We provide with it. We will turn over our work product, including any necessary files, and You will be responsible for their safekeeping. We are not required to keep copies, but ( If in any event of loss of files we can restore it at extra charge). You guarantee that you have the legal right to all elements of text, photographs, and anything else that you provide to us and that You will not hold us responsible for any third-party claims.
We will own any copyrightable work, ideas, inventions, products, or other information that We create in connection with the Services We are providing. We guarantee that we have the legal right to all elements related to the Services We are providing and will not hold You responsible for any third-party claims.
You agree that Powered by or Designed by iWeb Design line in the footer MUST be there at all times!
BOOKING SYSTEM - BoothPal
You or Your Company DOES NOT Own any copyrights to re-sell or make any copy of the Booking System ( BoothPal ) - iWeb Design is the owner of all files and its contents! Monthly payments are according to the package you have selected. BOOKING SYSTEM - BoothPal will be located on our Server for you to Manage everything! We'll be able to set up everything and you'll have all the necessary logins given to you where you be able to change them!
BoothPal Yearly GOLD and SILVER membership is %100 NON REFUNDABLE!
GOLD Membership can be purchased for 6 Months Minimum - NON REFUNDABLE!
Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL EITHER PARTY BE LIABLE TO THE OTHER PARTY OR ANY THIRD PARTY FOR ANY DAMAGES RESULTING FROM ANY PART OF THIS AGREEMENT SUCH AS, BUT NOT LIMITED TO, LOSS OF REVENUE OR ANTICIPATED PROFIT OR LOST BUSINESS, COSTS OF DELAY OR FAILURE OF DELIVERY.
HOSTING YOUR WEBSITE
if you already have a Hosting, the requirements are Linux Hosting with SSL. Please ensure to have your website hosting with SSL. We will install your website once completed but will require that you have it ready. Otherwise, let us host it for you by simply adding to your add-on. This will take away a lot of headaches if you don't know much about it.
If you want us to HOST your website, the charge is $249 a year or $699 for 3 years including SSL.
SUPPORT
We'll give you full support for 14 days after the website is LIVE to ensure everything is working and functioning properly. Any errors or issues will be fixed at NO EXTRA COST. Once your 14 days are over and you need us for any type of upgrades or support, extra fees will apply.
